Role Summary/Purpose: The candidate will be primarily responsible for managing all aspects of policy compliance, including, but not limited to: compliance program maintenance, review and enhancement, risk analysis, implementation of early warning systems in connection with July 2015 Corporate Governance Legislation, any new laws/regulations and Industry Code of Conduct such as Fenin and Farmaindustria, trending analysis in order to provide meaningful strategic information to support the Senior Leadership.
Essential Responsibilities:

  • Ensure full compliance with July 2015 Corporate Governance Legislation for all GEHC Legal entities in Spain in building a Corporate Compliance Program (Crime Prevention and Detection Model) which consists of:

    • Setting up and updating a risk assessment
    • Ensuring strong processes for controls to manage identified risks
    • Ensuring strong financial controls to detect offenses
    • Promoting a strong culture of Open reporting and encouragement to raise concerns with the relevant managers (whistleblowing)
    • Implementing sanctions for those who do not respect the compliance program
    • Implementing regular review of the program to ensure that it keeps up with the business and evolving best practices.

    The tasks will include a follow up the PwC on-going review and closure of recommendations in collaboration with GGO Compliance. A similar program shall be implemented for legal entities in Portugal.

  • Design and roll-out adequate policies and SOPs to the extent required by the Corporate Compliance program and work with different functions to make sure that such new policies and SOPs are consistent with the GE & GEHC Policies (to be considered as “minimum requirement”) such as The Lens and the Public Procurement Field Guide.
  • In order to optimize available resources this person will also be asked to support audits executed by the GEHC Monitoring and Internal Audit Team, CAS, Quality & Regulatory, EHS, the GGO Compliance team and external auditors as appropriate.
  • Plan and execute trainings to the GEHC Employees (e.g. Compliance Swing, NEO and other micro trainings) and Independent Third Parties on the policies and SOPs. Facilitate the delivery of Global Compliance trainings, monitor trainings and acknowledgments’ completion on the Compliance Executive Dashboard and follow up with employees accordingly. Report compliance trainings through the Compliance Activity Tracker (CAT) as appropriate.
  • Support Legal, Compliance, HR and other functions in investigating potential and/or alleged breach of the policies and SOPs involving the appropriate functions, providing recommendations and ensuring the application of the sanctions specified by laws and internal policies.
  • Be informed of any new legislation, changes in the existing legislation that may affect compliance program, including countries Industry Codes of Conduct such as Fenin and Farmaindustria. The recent update of Fenin code should be analyzed as a priority.
  • Work in close relationship with Compliance Manager of Italy to exchange best practices on Law
    231.
  • Be informed of Industry’s best-practices in Corporate Governance Legislation
  • Be the go-to-person contact for GEHC employees of Iberia needing assistance in understanding and implementing GEHC Policies and SOPs in order to be compliant and to take business decisions being aware of associated risks. Assist with compliance aspects of complex deals.
  • Manage the electronic Conflict of Interest and Competitors Contacts tools
  • Support the Compliance Centre of Excellence for the Improper Payments Prevention Activity, Indirect Distribution and Transparency Disclosure
  • Organize and drive Quarterly Compliance Review Boards for Iberia, part of Southern Europe CRB
  • Support Open Reporting and the GE Ombuds Program
  • Supervise the Compliance Communication Plan
  • Work in close relationship with the GGO Compliance Manager of Iberia
Qualifications/Requirements:

  • Legal or Economics degree
  • Strong experience in Compliance and/or internal audit in multinational companies operating in the Life Sciences Industry
  • Previous exposure to medical and pharmaceutical industry regulations
  • Knowledge of the local legislation. Experience with the U.S. Foreign Corrupt Practices Act (FCPA), Law 231 and of the U.K. Bribery Act is a plus
  • Solid understanding of business transactions, collaborations and market dynamics to meet customers’ needs
  • Ability to influence different stakeholders and decision makers (inside GEHC and vis a vis our Partners) through her/his expertise and using a “consultancy approach”, helping the business to manage risk intelligently
  • Demonstrated experience prioritizing conflicting demands from multiple business clients in an extremely fast paced environment
  • Strong ethical values and attitude towards independency, rigor, persistency and problem-solving
  • Ability to maintain confidentiality, excellent interpersonal skills and personal accountability
  • Very good knowledge of Microsoft Office applications
  • Very good proficiency in the Spanish and English languages
  • EU Work Permit

Non-national candidates are responsible to know the minimum documentation requirements to be able to be contracted in country: NIE- Social Security Affiliation Number in Spain (NAF) and Bank Account in Spain. They must be in possession of them at the time of start hiring. GE will not sponsor this requirement.
